Dual intent and permanent residency status in the United States

Some visas are of dual intent, referring to the concept that certain visitors may be temporarily present in the U.S. while acting in a manner that later leads to lawful and permanent residence (Green Cards). A foreign citizen with dual intent may openly and actively pursues permanent residency in the United States while maintaining the intention to return to their country of origin.

If dual intent is not allowed, the determination that the non-immigrant visa holder or applicant has the intent of pursuing a green card is grounds for termination of a visa, refusal of the visa application, refusal of admission at the port of entry, refusal of readmission or removal (deportation).

Dual intent (seeking permanent residency status in the U.S) is allowed for:

  • H1-B specialty workers
  • O-1 visas for workers with extraordinary ability
  • L-1 visas for corporate transferees

Dual intent is not allowed for business visitors and short-term visas

You may be able to obtain a short-term visa ("business visitor"). In order to obtain "business visitor" status, you must be able to demonstrate that you intend to return through residence and strong ties to your home country.
